Please read these Booking Conditions carefully. You will be bound by these Conditions upon payment of the deposit to Butler by the sea Pty Ltd (the Company).

The details on our website www.butlerbythesea.com are valid for the above period. Please note that maps on this website are not to scale and are provided only as a guide to locations. Hotel descriptions features are based on current international hotel guides and any facilities shown as included are subject to change at any time. Hotel room photographs may not be specific to actual room occupied. Subject to this, all information on the Company's website prepared by the Company is, to the Company's knowledge, correct at the time of publication. However the information should be checked prior to booking as it may have changed. Subject to law, the Company will not be liable for errors or omissions in such information or for information on the website provided by third parties.

Price Guarantee:Price is subject to change due to currency fluctuations against the Australian dollar. We stronly recommend that you make full payment as soon as possible to secure your price. Prices on our website, advertised prices, quoted prices, invoice prices or any other prices are based on costs, charges, tariffs, rates, prices, taxes and levies, exchange rates, airport charges, hotel rates and other service provider's tariffs as at 01 November 2012. In the event that there are any changes in these items which affect prices, we reserve the right to adjust our prices as necessary at any time. However, no surcharge in respect of cost or currency fluctuation will be made to the land arrangement of your holiday once full payment for your land content has been received. This does not apply to any taxes, charges or levies imposed by any government or their agencies.
Quoted Prices: Quoted prices will be held for 3 days only. The Company computer based process will be quoted as the current price. Any verbal quote given is an estimate only of price that will be subject to a written advice on confirmation of the booking.

Deposit and Payment: A non-refundable deposit of $400 per person must be received at the time you accept the Company's proposal (booking) . However if we are unable to confirm the accepted proposal then the deposit is fully refundable. Bookings that have no deposits paid on them are subject to cancellation without notice. All bookings are subject to availability at the time of booking. The balance of monies due to the company is to be paid no later than 60 days prior to departure. Some hotels may require a non-refundable deposit at time of booking. Inside 60 days full payment is due at time of booking however if we are unable to confirm the accepted proposal then the payment is fully refundable. If for any reason your balance of payment is not received by the due date we reserve the right to treat your booking as cancelled and to apply the appropriate cancellation charges. See below.

Cancellations and Refunds: Fees will be charged if you cancel or terminate your booking.

The Company's standard schedule of cancellation fees are as follows:

  • 60 days + prior to departure: forfeit of deposit
  • 59-46 days prior to departure: 25% of total price or deposit, whichever is greater
  • 45 days or less prior to departure: 100% of total price.

The above cancellation fees do not include fees levied by suppliers such as hotels, airlines, ground or cruise companies. The non-refundable deposit cannot be transferred to another booking. The non-issuance of an invoice, will not exempt customers from these cancellation fees.

There will be no refund after travel has commenced or for any unused inclusions such as accommodation, transfers, meals and tours. Please note that employees of any supplier are not authorised by the Company to make any undertakings in respect of refunds or other matters. Should you wish to cancel, you must advise the Company in writing.. A cancellation is not effective until the Company receives a signed written letter from you.

Amendments: An amendment of your booking will incur amendment fees. If after confirmation of your booking, you wish to change your itinerary or departure date, a fee of $33 per file including GST will be charged by the Company. Such fees will be in addition to any fees levied by hotels, ground operators, airlines or other service providers.

Gift vouchers: Are valid for 12 months from date of issue unless otherwise stated. Gift vouchers are non-refundable. Gift vouchers are valid for all travel arrangements including accommodation, tours & excursions, meal plans and flights. Gift vouchers may not be redeemed for flights only. This applies to international & domestic flights. Flights can only be booked in conjunction with accommodation.

Service Charge: A service charge of $33 per booking will be applied to land only booking of less than 5 nights, or car hire booking of less than 7 days, when the Company does not issue air tickets.

Late Bookings: A fee of $33 per booking will be charged for booking requests actioned inside 14 days of departure. Additional courier services may be needed to process late bookings. These courier deliveries will be charged at $15 per usage and will be added to the package price.

What's Not Included in the Holiday Price: Air fares, domestic airfares, airport taxes, passport and visa fees, insurance, laundry, phone calls, beverages, meals not detailed in the itinerary, tips to tour directors, motorcoach drivers and local city guides, items of a personal nature, excess baggage, expenses, fees or costs incurred in case of illness, or of refusal of entry, detention in, or expulsion or repatriation from a country or part of a country. The customer is liable for these items.

Travel Insurance: You should arrange your own insurance. The Company recommends travel insurance. However, the Company has no liability to you in respect of any such insurance or any matters arising from such insurance.

Holiday Variations: If unforeseen circumstances beyond our control require changes to your holiday, we reserve the right in consultation with the customer to cancel or reschedule departures and itineraries. Where it is necessary to change a hotel, the Company reserves the right in consultation with the customer to substitute accommodation of at least a similar standard at the customer's cost.

Scuba Diving: If is the responsibility of the party to ensure that all rule and guidelines for flying after diving are met.

Agency: The Company acts as an agent only. The Company sells various travel related products on behalf of numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators. The Company's obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. The Company has no responsibility for these services nor does the Company make or give any warranty or representation regarding their standard. All bookings are made on your behalf subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider and not the Company. If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the service provider and not against the Company. Consequently, the Company does not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of these service providers.

Limitations of Liability: The Company excludes all conditions and warranties implied by law except any implied condition or warranty, the exclusion of which would contravene any law or cause this clause to the void. The Company's liability for any such non-excludable conditions is limited to, at the Company's option, supplying the relevant services again or paying the cost of having the services supplied again. In all other circumstances, we do not accept any liability in contract, tort (including negligence) or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense, inconvenience or loss of enjoyment caused directly or indirectly by anything that may happen on your holiday or by anything we do unless the Company has engaged in wilful misconduct or by any event which is beyond our control.

Monies not held on Trust: All monies paid by you to the Company will be the property of the Company. Such monies will not be held by us on trust for and on behalf of you and we may hold such monies in any account as we see fit, including with our own and/or other customer monies.

Privacy Policy: The Company's Privacy Policy is available for viewing at www.butlerbythesea.com and is incorporated into these Booking Conditions.

Passports and Visas: It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of a country's immigration and other government authorities. All travellers must have a valid passport for international travel and many countries require at least 6 months validity form the date of return and some countries require a machine-readable passport. If the Company provides any information about such matters, the Company does not warrant the accuracy of such information and accepts no liability for any loss or damage which you may suffer in reliance on it.

Government Requirements: It is your responsibility to comply with the terms, conditions and requirements of any governmental authorities, and to bear all costs or losses incurred as a consequence of you not complying with them.

Travel Documents: Travel documents (such as airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider) may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documents will be your responsibility if not advised at the time of booking.

Complaints: Any complaints should be lodged in writing to the Company within 14 days after the event giving rise to the complaint with supporting documentation.

Governing Law: If any dispute arises in relation to these Conditions, the laws of New South Wales, Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New South Wales, and waive any right that you may have to object to an action being brought in those courts.

Interpretation: In these Conditions, reference to the singular include the plural and vice versa and words importing a gender include other genders.
