This privacy statement describes how BUTLER BY THE SEA Pty Ltd collects and uses the Personal Information you provide on our Website: butlerbythesea.com . It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. 2. Collection and Use of Personal Information

We collect the following Personal Information from you:

• Contact details: name, email address and phone number (optional).
• Trip details: destination, resort, travel dates, number of travellers and the ages of any children, budget, meal and transfer choices, and anything you tell us in your message.
• Payment details: on our payment page, your billing address and phone number. Card details are entered on our payment partner's secure page and are never seen or stored by us; we receive only confirmation of payment, the amount and a payment reference.
• Names of all travellers as shown on their passports, when you book.

We collect your personal information for the following purposes in relation to providing you with our travel services and advice and to assist you with booking travel and travel related products and services:

• Complete your travel bookings;
• Provide you with travel products, services and advice;
• Consider your request for a product or service;
• Assist in arrangements and reservations with suppliers (such as airlines, tour operators, car hire operators, hotels and insurance providers) in relation to the provision of a product or service;
• Collect and process payments, through us or a third party;
• Send you our newsletter, only if you ask to receive it;
• Process a transaction through our websites, over the phone, through a mobile application;
• Personalise the service or communication we provide to you, tailor your experience on our website or other websites to your interests and make more appropriate travel recommendations;
• Investigate, detect and protect us and other third parties against, negligence, breach of contract, fraud, theft and other illegal activities; and
• Respond to and manage inquiries, complaints, feedback and claims.

3. Choice/Opt-Out

You may stop receiving our marketing emails at any time by following the unsubscribe link in the email or by contacting hello@butlerbythesea.com. Client stories and photographs published on our website were shared with us by the clients concerned; if you would like a story or photograph about you amended or removed, contact us and we will do so.

4. Information Obtained from Third Parties

If you provide us Personal Information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us.

5. Information Sharing

We will share your Personal Information with third parties only in the ways that are described in this privacy statement. We do not sell your Personal Information to third parties. We may provide your Personal Information to companies that provide services to help us with our business activities such as:

• suppliers of products or services which you have selected (such as airlines, tour operators, car hire operators, hotels and insurance providers);
• third party travel service providers who assist in fulfilling the booking you have made;
• a person making your travel booking on your behalf;
• government authorities and our insurers in the event of an accident, disaster or emergency

We may also disclose your Personal Information

• as required by law such as to comply with a subpoena, or similar legal process
• when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request,
• if Butler by the sea Pty Ltd is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Website of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information,
• to any other third party with your prior consent to do so.

6. How we handle your enquiry

When you send an enquiry we store the details you provide (name, email, phone if given, travel dates, travellers, budget and your message) in our own systems and in our business mailbox so that a specialist can respond. If you write to us in a language other than English, the text of your message may be translated by an automated translation service so that our team can read it; only the message text is sent and it is not used for any other purpose. We share booking details with the resorts, transfer operators and other suppliers needed to arrange your travel, some of which are located outside Australia (for example in the Maldives and French Polynesia).

7. Overseas disclosure

Some of the organisations we share personal information with are outside Australia:

• the resorts and transfer operators that provide your holiday, in the Maldives and French Polynesia;
• our wholesale travel suppliers, including Stuba (United Kingdom) and Hotelbeds/Bedsonline (Spain);
• our email provider (Google), the automated translation service we use for messages not written in English (OpenAI), and our website host (Replit), all in the United States;
• our accounting system (Xero), whose data is stored in the United States;
• our payment partner (Mint Payments, Australia), whose secure payment page runs on Stripe's systems in the United States.

We share only the information each one needs for its part of your booking.

8. Payments

When you pay a deposit or balance, you are taken to our payment partner’s secure page. Your card details are entered there and are never seen or stored by Butler by the Sea. Our payment partner processes your payment under its own privacy policy and the PCI DSS standard. We receive confirmation that the payment succeeded, the amount, and a payment reference for reconciliation — not your card details. Paid amounts are recorded in our accounting system (Xero).

9. Travel insurance referral

If you choose to follow our link to Cover-More, you leave our website and any information you then provide is collected by Cover-More under its own privacy policy. We do not receive your quote or policy details; we may receive a commission if you purchase a policy.

10. Cookies and Analytics

We use Google Analytics to understand how visitors use our website, such as which pages are viewed and how visitors arrive. Google Analytics sets cookies in your browser and Google processes this information in the United States. If you are in the European Economic Area, the United Kingdom or Switzerland, these cookies are only set if you accept them in our cookie banner; elsewhere analytics can start automatically and you can decline it in the banner or Cookie settings at any time. We determine your country using an offline country database on our server, without sending your IP address to a geolocation service. If we cannot determine your country reliably, analytics waits for your acceptance. We do not send your name, email address or other contact details to Google Analytics. Our website host also sets a technical cookie needed to deliver the website, and a cookie keeps our staff signed in to the administration area. Your language choice is remembered in your own browser.

11. Links to Other Websites

Our Site includes links to other Websites whose privacy practices may differ from those of Butler by the Sea. If you submit Personal Information to any of those sites, your information is governed by their privacy statements. We encourage you to carefully read the privacy statement of any Website you visit.

12. Security

The security of your Personal Information is important to us. We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. Payments are made on our payment partner’s secure page (see “Payments”); we never see or store your card details. We retain enquiry and booking information for as long as needed to provide our services and to meet our legal obligations, resolve disputes, and enforce our agreements. All pages and forms on our website are served over encrypted (HTTPS/TLS) connections.

We do not use automated decision-making that significantly affects your rights or interests.

We use your personal information to answer your enquiry and arrange and manage your booking (this is necessary to take steps at your request and to perform our contract with you), to send you our newsletter if you have asked for it (based on your consent, which you can withdraw at any time), and to keep our business records and protect our legal rights (our legitimate interests and legal obligations). You have the right to ask for access to your information, to have it corrected or deleted, to restrict or object to how we use it, and to receive a copy of information you gave us in a commonly used format. Because we are based in Australia and work with the providers listed under Overseas disclosure, your information is transferred outside your country; we share only what each needs to provide its service.
